Abstract

The purpose of Guardians and Wards, Act, 1890 is not merely physical custody of minor but the protection of the rights of ward’s health, maintenance education with love and affection, which is required to balancing the rights and responsibilities on the part of parents as provided under modern and Islamic legal system. The family Courts in Pakistan are recognizing the best interest of the child’s rights being custodian of the minors in accordance with  the existing laws/rules.  This article examines the legal framework governing child custody and guardianship in Pakistan, with a focus on balancing the rights of Children and the responsibilities of Parents, the State and judicial institutions. It explores statutory provisions, Islamic personal law influences, evolving jurisprudence emphasizing the best interests of the child, and specific case laws reflecting contemporary judicial reasoning.  In Pakistan custody and guardianship disputes are a complex narrative of competing rights and responsibilities. At the heart of this core issue lies with quest to balance parental claims towards protection of  child’s best interests. This article delves into Pakistan’s legal landscape, where Islamic Law and statutory frameworks i.e. Guardians and Wards Act, 1890, converge to shape custody decisions.  The analysis reveals that how courts prioritize factors like the child’s welfare, parental fitness, and maternal parental rights , some times yielding outcomes that reflect  Pakistan’s Sociocultural context. Hence, Pakistan navigates it’s obligations under the UN Convention on the Rights of Child (UNCRC), this research study highlights the efficacy of present time legal frameworks in safeguarding children’s rights, through content analysis under review of literature based on qualitative method analysis. The purpose of this study is to addressing significant issues and ownership of rights with responsibilities  to value add through suggesting, recommendations for legal and policy reforms are offered to enhance protection of child’s rights and procedural fairness while deciding  such cases on any forum.
