Strengthening Culpability for Disability Rights: Obligations, Monitoring, and Enforcement Role of the Committee on the Rights of Persons with Disabilities
Abstract
This work analyzes the management and general implementation of the United Nations Convention on the Rights of Persons with Disabilities (UNCRPD) in developing and developed countries through discussion of national and international monitoring mechanisms of the Convention and the function of the Committee on the Rights of Persons with Disabilities (CRPD). UNCRPD needs State Parties to realize their obligations within their domestic legal order. To be more effective, UNCRPD stresses the national and international monitoring and enforcement of the Convention and gives detailed provision on the issue. This paper gives innovative provision on “conference of State parties” and “international cooperation.” Concluding observation of the CRPD on UK’s progress report gives a reflection of the monitoring and realization situation of UNCRPD in a developed country. At the same time, the paper discusses critical observation and investigation of the CRPD based on evidence from a variety of sources against UK for nonfulfillment of rights of persons with disabilities.
